Between 1905 and 1945, 31 states in the Untied States and 2 provinces in Canada enacted sterilization legislation. Over 70 statutes and amendments were enacted to guide, oversee and regulate sterilization practice, while over 24 distinct conditions were offered as grounds for sterilization. Although excellent legal, historical, and philosophical scholarship has investigated the motivations, causes and consequences of this legislation, little work has been done to explicitly systematic analyse the language used in sterilization legislation. This brief study attempts to fill (...) some of the gap by attending to a number of questions that arise in the context of sterilization legislation. Five questions are addressed: Are there any patterns to the eugenic language in sterilization legislation? Does the eugenic sterilization language reflect what is found on other eugenic lists? What can sterilization language tell us about the mechanics of eugenics? What can sterilization legislation reveal about the role of feeble-mindedness or mental deficiency in eugenic history? And finally, what might sterilization language tell us about eugenic thought more generally? In answering these questions, we look to add one more piece to the puzzle that is eugenic history in North America. (shrink)

Kant distinguishes between ‘active’ and ‘passive’ citizens and holds that only the former are civilly self-sufficient and possess rights of political participation. Such rights are important, since for Kant state institutions are a necessary condition for individual freedom. Thus, only active citizens are entitled to contribute to a necessary condition for the freedom of each. I argue that Kant attributes civil self-sufficiency to those who are not under the authority of any private individual for their survival. This reading is more (...) textually grounded than the dominant reading, which understands civil self-sufficiency in terms of economic relations alone. I further argue that Kant was interested in relations of authority because he was concerned to eliminate certain forms of corruption. This indicates that Kant’s contested distinction between active and passive citizens was a response to a key problem of any account of public lawgiving. (shrink)

This article discusses five attempts at justifying the provision of welfare on Kantian grounds. I argue that none of the five proposals is satisfactory. Each faces a serious challenge on textual or systematic grounds. The conclusion to draw from this is not that a Kantian cannot defend the provision of welfare. Rather, the conclusion to draw is that the task of defending the provision of welfare on Kantian grounds is a difficult one whose success we should not take for granted.

In this paper we discuss how Causal Decision Theory should be modified to handle a class of problematic cases involving deterministic laws. Causal Decision Theory, as it stands, is problematically biased against your endorsing deterministic propositions (for example it tells you to deny Newtonian physics, regardless of how confident you are of its truth). Our response is that this is not a problem for Causal Decision Theory per se, but arises because of the standard method for assessing the truth of (...) certain counterfactuals. The truth of deterministic laws is `modally fragile' on the standard semantics for counterfactuals: if determinism is true and you were to do otherwise, the laws would be different. We provide two ways of avoiding this problem: 1) supplement the standard semantics for counterfactuals with impossible worlds, or 2) introduce rigid designators into the description of problematic decision situations. We argue that both of these approaches are well-motivated and can be readily incorporated into Lewisian Causal Decision Theory. (shrink)

This philosophical treatise on the foundations of semantics is a systematic effort to clarify, deepen and defend the classical doctrine that words are conventional signs of mental states, principally thoughts and ideas, and that meaning consists in their expression. This expression theory of meaning is developed by carrying out the Gricean programme, explaining what it is for words to have meaning in terms of speaker meaning, and what it is for a speaker to mean something in terms of intention. But (...) Grice's own formulations are rejected and alternatives developed. The foundations of the expression theory are explored at length, and the author develops the theory of thought as a fundamental cognitive phenomenon distinct from belief and desire, argues for the thesis that thoughts have parts, and identifies ideas or concepts with parts of thoughts. In neocolonial contexts of globalization, the epistemological terrain of radical diversity poses significant ethical challenges to transnational feminisms. In view of historical associations between knowledge and discourses of love which were conditioned by imperialist brands of humanism and benevolence under colonialism, this paper argues for a deconstructionist approach to conceptualizing love in relation to knowledge and for an ethics that severs the association with benevolence, instead making alterity the basis for its account.

Down syndrome (DS) impacts several brain regions including the hippocampus and surrounding structures that have responsibility for important aspects of navigation and wayfinding. Hence it is reasonable to expect that DS may result in a reduced ability to engage in these skills. Two experiments are reported that evaluated route-learning of youth with DS, youth with intellectual disability (ID) and not DS, and typically developing (TD) children matched on mental age (MA). In both experiments, participants learned routes with eight choice point (...) presented via computer. Several objects were placed along the route that could be used as landmarks. Participants navigated the route once with turn indicators pointing the way and then retraced the route without them. In Experiment 1 we found that the TD children and ID participants performed very similarly. They learned the route in the same number of attempts, committed the same number of errors while learning the route, and recalled approximately the same number of landmarks. The participants with DS performed significantly worse on both measures of navigation (attempts and errors) and also recalled significantly fewer landmarks. In Experiment 2, we attempted to reduce TD and ID vs DS differences by focusing participants’ attention on the landmarks. Half of the participants in each group were instructed to identify the landmarks as they passed them the first time. The participants with DS again committed more errors than the participants in the ID and TD groups in the navigation task. In addition, they recalled fewer landmarks. While landmark identification improved landmark memory for both groups, it did not have a significant impact on navigation. Participants with DS still performed more poorly than did the TD and ID participants. Of additional interest, we observed that the performance of persons with DS correlated with different ability measures than did the performance of the other groups. The results the two experiments point to a problem in navigation for persons with DS that exceeds expectations based solely on intellectual level. (shrink)

The injunction to “analyze the way you randomize” is well known to statisticians since Fisher advocated for randomization as the basis of inference. Yet even those convinced by the merits of randomization-based inference seldom follow this injunction to the letter. Bernoulli randomized experiments are often analyzed as completely randomized experiments, and completely randomized experiments are analyzed as if they had been stratified; more generally, it is not uncommon to analyze an experiment as if it had been randomized differently. This article (...) examines the theoretical foundation behind this practice within a randomization-based framework. Specifically, we ask when is it legitimate to analyze an experiment randomized according to one design as if it had been randomized according to some other design. We show that a sufficient condition for this type of analysis to be valid is that the design used for analysis should be derived from the original design by an appropriate form of conditioning. We use our theory to justify certain existing methods, question others, and finally suggest new methodological insights such as conditioning on approximate covariate balance. (shrink)

Does ethical content in organizational mission statements make a difference? Research regarding the effectiveness and results of mission statements is mixed. Krohe concluded that much of the good results do not come from the mission statements themselves but from the strategic re-education that happens in producing one. We attempted to discover whether universities that explicitly state their ethical orientation and vision in their mission statements had students with higher perceived character trait importance and activities that reinforce character than universities that (...) did not. While the faculty and administration may receive benefits from mission statement development through strategic re-education as Krohe suggested, do the statements influence the students at the university who may have had no role in its creation? Using a sample of senior business students at 16 universities we found that students at universities with ethical statements in their mission statements had significantly higher perceived character trait importance and character reinforcement than those at universities whose missions lacked ethical statements. This research suggests that schools that explicitly stated ethical content in their mission statements do influence student ethical orientation. (shrink)

Teachers are no longer simply being told what to teach, but also how to teach it. It is important therefore to examine whether some prescriptions of teaching methods are acceptable while others are not, and to justify opposition to certain forms of prescription. I show that some attempts to prescribe teaching methods are either empty, or incompatible with holding teachers to account for the pupil learning which is supposed to result. My argument does not depend on making any value assumptions (...) about ultimate educational aims. Examples from the National Literacy and Numeracy Strategies are discussed. (shrink)

ABSTRACT:The ethics of high frequency trading are obscure, due in part to the complexity of the practice. This article contributes to the existing literature of ethics in financial markets by examining a recent trend in regulation in high frequency trading, the prohibition of deception. We argue that in the financial markets almost any regulation, other than the most basic, tends to create a moral hazard and increase information asymmetry. Since the market’s job is, at least in part, price discovery, we (...) argue that simplicity of regulation and restraint in regulation are virtues to a greater extent than in other areas of finance. Is it morally important to vote? It is common to think so, but both consequentialist and deontological strategies for defending that intuition are weak. In response, some theorists have turned to a role-based strategy, arguing that it is morally important to be an excellent citizen, and that excellent citizens vote. But there is a lingering puzzle: an individual vote changes very little (virtually nothing in large-scale elections), so why would the excellent citizen be so concerned to cast a ballot? Why (...) bother with something that has so little effect on the common good? This paper answers by developing the idea of respect for a practice, and then arguing that respect for democracy will often require citizens to vote. (shrink)

The pioneering work of Johann Winckelmann (1717-1768) identified a homoerotic appreciation of male beauty in classical Greek sculpture, a fascination that had endured in Western art since the Greeks. Yet after Winckelmann, the value (even the possibility) of art's queer beauty was often denied. Several theorists, notably the philosopher Immanuel Kant, broke sexual attraction and aesthetic appreciation into separate or dueling domains. In turn, sexual desire and aesthetic pleasure had to be profoundly rethought by later writers. Whitney Davis follows (...) how such innovative thinkers as John Addington Symonds, Michel Foucault, and Richard Wollheim rejoined these two domains, reclaiming earlier insights about the mutual implication of sexuality and aesthetics. Addressing texts by Arthur Schopenhauer, Charles Darwin, Oscar Wilde, Vernon Lee, and Sigmund Freud, among many others, Davis criticizes modern approaches, such as Kantian idealism, Darwinism, psychoanalysis, and analytic aesthetics, for either reducing aesthetics to a question of sexuality or for removing sexuality from the aesthetic field altogether. Despite these schematic reductions, sexuality always returns to aesthetics, and aesthetic considerations always recur in sexuality. Davis particularly emphasizes the way in which philosophies of art since the late eighteenth century have responded to nonstandard sexuality, especially homoeroticism, and how theories of nonstandard sexuality have drawn on aesthetics in significant ways. Many imaginative and penetrating critics have wrestled productively, though often inconclusively and "against themselves," with the aesthetic making of sexual life and new forms of art made from reconstituted sexualities. Through a critique that confronts history, philosophy, science, psychology, and dominant theories of art and sexuality, Davis challenges privileged types of sexual and aesthetic creation imagined in modern culture-and assumed today. This study reassesses the concept of the Anthropocene as a new geological age as it is influencing contemporary debates in social theory. As a unit of geological time whose changes are allegedly caused, directly and indirectly, by human beings, this scientific concept challenges the existing constructions of theoretical binaries, such as nature/culture, environment/society, objectivity/subjectivity or happenstance/design, in social theory. The analysis suggests many understandings of the Anthropocene in social theory are politicized over-interpretations of natural events, and these moves appear to (...) be developing moral rhetorics of, and operational plans for, managing the Anthropocene to create specific outcomes for those who are the managers as well as the managed. The fact that human beings do not, in fact, have this measure of technical control is ignored by advocates of Anthropocenarian politics to advance their policy agendas. (shrink)

ABSTRACTAssuming there are fictional objects, what sorts of properties do they have? Intuitively, most of their properties involve being represented—appearing in works of fiction, being depicted as clever, being portrayed by actors, being admired or feared, and so on. But several philosophers, including Saul Kripke, Peter van Inwagen, Kendall Walton, and Amie Thomasson, argue that even if there are fictional objects, they are not really represented in some or all of these cases. I reconstruct four kinds of arguments for this (...) unexpected conclusion; they concern the semantics of names, pragmatic force, creation, and representations’ qualitative content. But I find all the arguments flawed. I then argue for the contrary, employing a new perspective: representation of fictional objects begins with the works of fiction that originate them. A work of fiction represents its “native” objects because our culture bestows that property on it. I sketch conditions for such property bestowal and argue that they are satisfied in this case. Over the last two decades the traditional conception of intelligence and other mental powers as stable individual assets has been challenged by approaches in psychology emphasising context and ‘situated cognition’. This paper argues that the debate should not be seen as an empirical dispute, and relates it to discussions in philosophy of mind between methodological solipsists and varieties of externalists. In the light of this I argue that attempts to conceptualise the identity over time of mental powers qua individual assets (...) run into intractable difficulties. Hence ‘individual asset’ views of many abilities should be abandoned. Implications for education policy particularly in regard to assessment are explored. (shrink)

Sydney Shoemaker has claimed that functionalism, a theory about mental states, implies a certain theory about the identity over time of persons, the entities that have mental states. He also claims that persons can survive a “Brain-State-Transfer” procedure.My examination of these claims includes description and analysis of imaginary cases, but-notably-not appeals to our “intuitions” concerning them.It turns out that Shoemaker’s basic insight is correct: there is a connection between the two theories. Specifically, functionalism implies that “non-branching functional continuity” is sufficient (...) for personal identity. But there is no implication that it is necessary. And the “BST” procedure may not preserve functional continuity. I consider several possibilities. On what may be the most attractive, the survivor of this---or any similar---procedure is not identical with the original person, but related to him or her as are the survivors in a case of fission. I analyze the “Sportsman’s Code,” arguing that several of its rules presuppose a respect for animals that renders hunting a prima facie wrong. I summarize the main arguments used to justify hunting and consider them in relation to the prima facie case against hunting entailed by the sportsman’s code. Sport hunters, I argue, are in a paradoxical position—the more conscientiously they follow the code, themore strongly their behavior exemplifies a respect for animals that undermines the possibilities of justifying hunting altogether. In this paper I challenge the reader to witness the environmental and feminist aegis as an epicine confrontation with nature whose main goal is to reconcile a lost partnership with the archetype I have labeled Sophia. Sophia, whose providential origins lie somewhere amid the great pre-Hellenic gnostic cults, can only bring salvation if she is liberated by humanity through the resacralization of nature. It is this change in consciousness that points toward a radical environnlental ethic and a total reconceptualization of (...) the becoming process. (shrink)
